Terms of Service

These Terms of Service ("Terms") govern the use of the aning-moments application and related services (collectively, the "Service"). By using the Service, users ("Users") agree to these Terms.

Article 1 – Application

These Terms apply to all relationships between Users and the operator of the Service regarding the use of the Service.

The Service operator may establish additional rules or guidelines regarding the Service. Such rules shall constitute a part of these Terms.

Article 2 – Registration

Users may register for and use the Service in accordance with the procedures specified by the Service.

Users agree to provide accurate and complete information during registration and may not provide false information.

Article 3 – Prohibited Activities

Users agree not to engage in any of the following activities while using the Service:

  • Violating laws or public order and morals
  • Engaging in criminal activities
  • Interfering with the operation of the Service
  • Causing harm or disadvantage to other Users or third parties
  • Impersonating another person or entity
  • Attempting unauthorized access to the Service
  • Posting or sharing content that is unlawful, obscene, defamatory, threatening, or harassing
  • Infringing on the intellectual property rights of others
  • Posting content that contains personally identifiable information of others without their consent
  • Attempting to circumvent content moderation or reporting systems
  • Any other activities deemed inappropriate by the Service operator

Article 4 – User Content and Community Features

4.1 Ownership: Any text, images, or other content submitted, posted, or stored by Users through the Service ("User Content") remains the property of the respective User.

4.2 Representations: Users represent and warrant that they possess the necessary rights to any User Content they submit and that their content does not violate any applicable laws or third-party rights.

4.3 License to Service: By submitting User Content, Users grant the Service operator a non-exclusive, worldwide, royalty-free license to use, display, and store such content solely to the extent necessary for providing, maintaining, and improving the Service. This license does not grant the Service operator ownership or the right to sell User Content.

4.4 Theme Submissions: Users may voluntarily submit diary pages to monthly community themes ("Submissions"). By submitting:

  • Users acknowledge that their Submission (including text and images) will be visible to other users of the Service
  • Users agree that Submissions are subject to automated AI content moderation
  • The Service operator reserves the right to hide, remove, or reject any Submission that violates these Terms without prior notice
  • Users may remove their Submission at any time through the app's interface

4.5 Public Profiles: Users may optionally add social media links to their profile. These links will be displayed on the user's public profile page.

4.6 User Blocking: Users may block other users. Blocked users will not be able to view the blocking user's public content.

4.7 Reporting: Users may report content they believe violates these Terms. Reports are reviewed by administrators. Submitting false or abusive reports is prohibited.

Article 5 – Content Moderation

The Service operator employs automated systems (including AI moderation) and user reporting mechanisms to maintain a safe environment. The operator reserves the right, without prior notice, to:

  • Review, hide, or remove any User Content that violates these Terms
  • Suspend or terminate access for Users who repeatedly violate these Terms
  • Reject or remove theme submissions that are deemed inappropriate
  • Forward reported content to appropriate authorities if required by law

Moderation decisions are made at the sole discretion of the Service operator.

Article 6 – Modification or Suspension of the Service

The Service operator reserves the right to modify, add to, suspend, or discontinue all or part of the Service at any time without prior notice.

Article 7 – Disclaimer

The Service operator does not guarantee that the Service will be free from defects, errors, interruptions, or other issues related to safety, reliability, accuracy, completeness, or fitness for a particular purpose.

The Service operator shall not be liable for any damages arising from the use of the Service, except in cases of intentional misconduct or gross negligence.

The Service operator does not guarantee the complete protection or preservation of User data.

The Service operator is not responsible for User Content posted by other users and does not endorse any User Content.

Article 8 – Changes to These Terms

The Service operator reserves the right to modify these Terms when deemed necessary. Updated Terms shall become effective upon posting within the Service or through other appropriate notice.
